ALL AMERICAN ONLINE CONTEST RULES
NO PURCHASE NECESSARY: FREE ENTRY
This is a game of skill. Winners will be determined by the objective criteria set forth below.
From all eligible entries received, the winners will be determined by the participant who uses his or her handicapping skill and knowledge of American Quarter Horse racing to accumulate the most points during the All American Online Contest according to these Game Rules (the "Game"). Term runs from 9 a.m. CDT August 28, 2006 to 1 p.m. CDT September 3, 2006. All entries, along with all copyright, trademark and other proprietary rights associated therewith, become the property of American Quarter Horse Association ("AQHA").
CONDITIONS
1) Players will enter the contest by entering their name, address, e-mail address and selections for the All American Derby and All American Futurity to be run September 3 and 4, 2004 at Ruidoso Downs.
2) Only one entry per person and one entry per e-mail address. Duplicate or multiple entries from any one person or any one e-mail address will result in disqualification of all involved entries.
3) Once an entry has been submitted, it cannot be changed for any reason.
4) In the event that one or more horses are scratched or for any reason do not start in either contest race, the post time favorite will be substituted. If a player has already selected the post time favorite as another selection, then the next-favored horse that the player has not selected will be used. In the event that a coupled entry is favored, then the fastest qualifier from the entry will be the substitute selection. No substitutions will be allowed.
5) Any player that selects the same horse more than once in one or both of the contest races will be considered ineligible.
SCORING
1) Points will be based on the official order of finish posted by the stewards at Ruidoso Downs.
2) Points will be awarded according to the following schedule: 1st - 10 points, 2nd - 6 points, 3rd - 3 points and 4th - 1 point. The order that the horses are selected does not matter for scoring purposes. If a player's selection is scratched or for any reason does not start in either contest race, the post time favorite will be substituted. If a player has already selected the post time favorite as another selection, then the next-favored horse that the player has not selected will be used. In the event that a coupled entry is favored, then the fastest qualifier from the entry will be the substitute selection.
3) In the event of a dead heat, points will be evenly split between the involved horses. For example, if there is a dead heat for first, then each horse will receive half of the first and second-place points (10+6 divided by 2) or 8 points.
4) Players will earn points only for the horses they select, and not for any horse(s) which may be coupled with that selection for wagering purposes.
SELECTION OF WINNERS
1) The winner of the contest will be the contestant with the highest total points.
2) It is the responsibility of the player to bring any alleged error to the attention of AQHA by sending an email to cmorris@aqha.org.
3) In the event that there is a tie between two or more players for the highest point total at the end of the contest, the player who came closest to guessing the final and official time of the the contest year's All American Futurity will be the winner. This also will be used to break any tie for all prizes. In the event that two or more tied players submit identical guesses or two or more players tie for the closest guess, then a random drawing will determine the winner.
OTHER RULES
1) AQHA and The American Quarter Horse Racing Journal Online may post past performance information and a handicapping analysis of the contest races. AQHA and The American Quarter Horse Racing Journal Online shall not be liable for any inaccurate, incomplete, or missing information that is posted. Such information is posted only to help players make their selections and any opinions or analysis posted by AQHA and The American Quarter Horse Racing Journal Online regarding the outcome of the races should not be taken as a recommendation of which horses to select.
2) AQHA shall act as the sole judge for any discrepancies or situations not covered in these rules. AQHA reserves the right to interpret all questions and conditions regarding the contest, without claim for damages or recourse of any kind. All questions regarding the contest, which are not specifically listed under these rules will be decided by AQHA. Those decisions will be final. By entering this contest, all contestants agree to abide by these rules and accept the decisions of AQHA as final.
ELIGIBILITY
This Game is open to all legal residents of the United States and provinces of Canada except where prohibited otherwise by law. Persons residing in any jurisdiction where applicable law prohibits participation in this Game are not eligible to enter this Game. All federal, state and local laws and regulations apply. Employees of American Quarter Horse Association (AQHA), Ruidoso Downs Racetrack & Casino, National Thoroughbred Racing Association (NTRA), The American Quarter Horse Racing Journal, Daily Racing Form, and their respective subsidiaries, contractors, directors, advertising agencies, and their respective immediate family members are not eligible.
DISCLAIMER
AQHA or The American Quarter Horse Racing Journal or The American Quarter Horse Racing Journal Online will not be responsible for any: (a) late, lost, garbled, misdirected, incomplete, or damaged entries; (b) any game disruptions, injuries, losses or damages caused by events beyond the control of AQHA; or (c) any printing or typographical errors in any materials associated with the Game.
ENTRY
Entries to join the Game and select the horses may be made from 9 a.m. CDT on August 28, 2006 to the end of the registration period at 1 p.m. CDT on September 3, 2006. This is an Internet-based game only. Entries will be accepted only through the online entry and selection form. No faxed, mailed, electronically mailed, or phoned in entries are allowed.
Only one entry per person is allowed. More than one entry from the same person is cause for disqualification of all involved entries. Before prizes are awarded, the entire pool of players will be checked for duplicate entries. If a player's email address is deemed to be invalid by AQHA, that player may be disqualified.
A player's name, hometown and score may be listed on the AQHA's Web site, The American Quarter Horse Racing Journal Online.

Odds of winning depend on the number of players and skill level of each player. All prizes will be awarded regardless of the number of players. Prizes are not transferable and no substitution of prizes is permitted except that AQHA reserves the right to substitute a prize of equivalent value if a prize is unavailable. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES AND ANY SHIPPING OR HANDLING CHARGES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
There will be no substitution of prizes and no compensation awarded in lieu of any prizes.
NOTIFICATION
Winners will be notified by e-mail by September 15, 2006 and may be required to sign and return an affidavit of eligibility and acceptance of these Official Rules and a publicity/liability release (unless prohibited by law) within ten (10) days following attempted notification. Any prize returned as undeliverable may result in disqualification and selection of an alternate winner. By accepting any prize, winner (and, if applicable, companion) grant permission to AQHA and The American Quarter Horse Racing Journal to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent. In the event of a dispute about the identity of any player, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide the sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
GENERAL RELEASE
By participating in the game, you (and, if you are a minor, your parents or legal guardians) release and agree to hold harmless AQHA, The American Quarter Horse Racing Journal, The American Quarter Horse Racing Journal Online, Ruidoso Downs Racetrack & Casino, NTRA, Daily Racing Form, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Game or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

INTERNET/TECHNOLOGY PROBLEMS
If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of AQHA or The American Quarter Horse Racing Journal or The American Quarter Horse Racing Journal Online, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this game and contest, AQHA or The American Quarter Horse Racing Journal or The American Quarter Horse Racing Journal Online reserves the right, in its sole discretion, to disqualify any individual who violates these Game Rules or the associated rules sets referenced Herein, if any, tampers with the entry process, or engages in any conduct detrimental to AQHA or The American Quarter Horse Racing Journal or The Quarter Horse Journal or The American Quarter Horse Racing Journal Online, the Game or any other player (in each case as determined in AQHA's or The American Quarter Horse Racing Journal's or The American Quarter Horse Racing Journal Online's sole discretion), to lock out any individual whose eligibility is in question, and to cancel, terminate, modify or suspend this Game at any time. The Released Parties assume no responsibility for, and will not be liable for, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. None of the Released Parties are in any way responsible or liable for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by AQHA or The American Quarter Horse Racing Journal or The American Quarter Horse Racing Journal Online on account of technical problems or traffic congestion on the Internet or at any associated Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading of any materials in this Game.
This Game has been designed to be compatible with as many operating systems, Web browsers and computer systems as possible, however; AQHA, The American Quarter Horse Racing Journal and The American Quarter Horse Racing Journal Online makes no guarantee that this Game will be compatible with any particular computer system and AQHA, The American Quarter Horse Racing Journal and The American Quarter Horse Racing Journal Online shall have no responsibility to make the Game compatible with any particular computer system.

This Game is subject to these Game Rules and any other rules sets expressly referenced herein. Game players agree to abide by the terms of these Game Rules and by the decisions of AQHA or The American Quarter Horse Racing Journal or The American Quarter Horse Racing Journal Online, which are final on all matters pertaining to this Game. AQHA and The American Quarter Horse Racing Journal and The American Quarter Horse Racing Journal Online reserves the right to change these Game Rules at any time, in its sole discretion.
