A Wednesday hearing in a suit brought by the Texas Horsemen's Partnership against the state comptroller has been postponed.

The suit concerns funding of the Texas Racing Commission.

According to Daily Racing Form, the original date was bumped off the calendar after the Texas attorney general's office filed a motion to push back the hearing until after the February 9 meeting of the commission. David Cabrales, an attorney for the THP, said that a motion for reconsideration has been filed.

"We're guardedly optimistic our motion for reconsideration will get a favorable response," Cabrales told DRF.

The racing commission's administrative costs are being covered through a temporary plan that runs through February 29.

In other Texas racing news, the state racing commission has released the agenda for its February 9 meeting, and it includes a discussion of the Historical Racing issue. Click here to read more from Daily Racing Form.
